I found this...

http://ppewww.ph.gla.ac.uk/~flavell/www/content-type.html

It suggests IE may interpret the xhtml document sent as "text/html" as 
XML not HTML if it doesn't encounter <html> close to the top of the 
page.  It ignores the mime type. :(

What versions of IE are you running?
